Ontario Superior Court rules anti-prostitution laws unconstitutional

CBC news is reporting that Ontario's Superior Court of Justice has ruled three Criminal Code provisions relating to prostitution are unconstitutional. Justice Susan Himel said those provisions contribute to the danger faced by sex-trade workers.

CBC news is reporting that Ontario's Superior Court of Justice has ruled three Criminal Code provisions relating to prostitution are unconstitutional.

Justice Susan Himel said those provisions contribute to the danger faced by sex-trade workers.

She also suspended the effect of her decision for 30 days.

The decision will, when it comes into effect in 30 days, render bawdy houses legal, make it legal to communicate for the purpose of prostitution and to live off the avails of prostitution in Ontario.

In her judgement Himel said these provisions restricted the activities of prostitutes and were in violation of their charter rights of security of the person and freedom of expression.
