Two males charged under the New Street Racing Law

Robert Bailey, age 20, of 175 Tancred Street was charged with one count of fail to stop for police under the Criminal Code of Canada, in addition he was also charged under the Highway Traffic Act of Ontario with one count of street racing under the new Street Racing Law.

24 year-old Brent Bellmore of 624 Lennox Avenue was also charged with one count of street racing and one count of operate motor vehicle without insurance under the Compulsory Automobile Insurance Act of Ontario.
Both drivers had their licences seized and suspended for seven days. Their vehicles were towed and will be impounded for seven days.

It is alleged that on the 7th of June at approximately 4:15 pm, the accused Robert Bailey, who was operating a black 1993 Pontiac Trans Am, was racing a male known to him, Brent Bellmore, who was operating a green 1995 Eagle Talon on Queen Street East in the area of Parkdale. An officer conducting radar observed the two vehicles travelling at a high rate of speed and appeared to be racing. The vehicles were observed driving very closely to one another, swerving in an out of traffic, causing other motorists in the area to pull over to the side of the roadway. The vehicles were clocked at a speed of 103km/hr in a 50km/hr zone. When police attempted to stop the accused Robert Bailey, with the cruiser lights flashing and siren activated, he accelerated and sped off at a high rate of speed and failed to stop. Due to public safety, a full police pursuit was not initiated.

Through police investigation, officers were able to identify and locate both the drivers a short time later and the charges were laid. The accused Robert Bailey is to appear in court on the Criminal Code Charge of failing to stop for police on the 14th of July and will appear in Provincial Offences Court on the 9th of July for the Highway Traffic Act charge.
Brent Bellmore is to appear in Provincial Offences Court on the 9th of July.

The new law, which is enforced under the Highway Traffic Act, came into effect in Ontario in the fall of 2007. It allows for much tougher penalties for drivers doing more than 50 km/h over the speed limit. The law now means that cars will automatically be impounded for 7 days, driver's licenses are suspended for a week, and a minimum fine of $2,000 is imposed for anyone caught driving 50 km over the posted speed limit.
Courts can impose a driver's licence suspension of up to 10 years for a second conviction, if the second conviction occurs within 10 years of the first. For a first conviction, the maximum suspension period remains at two years.
