Man from alleged urine incident on city bus gets probation

A local man, with "anger issues," received a suspended sentence Wednesday and was placed on probation for two years for striking a city bus driver in April.

When he imposed the sentence, Ontario Court Justice Romuald Kwolek called the 28-year-old's behaviour "clearly unacceptable" and noted the accused had been drinking that night.

Jordan Wiles pleaded guilty to the April 16 assault during an earlier court appearance, at which time the judge heard the facts of the case.

When he was charged, city police reported he was travelling on the bus and was asked several time to turn down the music he was listening to.

It was alleged that he urinated in a bottle, poured it near the driver and then struck him in the face.

On Wednesday, assistant Crown attorney Matthew Caputo suggested the suspended sentence, with one-year probation and 40 hours of community service.

Noting the accused's anger issues, he said Wiles also should be required to undergo counselling for anger management and not have any weapons.

Wiles, whose prior involvement with the justice system involved a discharge, told the judge "this is the last time you will see me."

Kwolek asked "do you know what happens when you get three strikes?"

"You're out," the man replied.

The judge said he was agreeing to a suspended sentence, but was going to put Wiles on a longer period of probation than the year sought by the Crown.

During his probation, he must undergo any recommended assessments and counselling, including anger management, can't possess weapons and must do the 40 hours of community service.

Wiles can have no contact with the victim and must stay 10 metres away from him.

Kwolek also ordered him to provide a DNA sample for the national database.
