Notice of Passing of a Zoning By-law By the Corporation of the Town of Collingwood

Take notice that the Town of Collingwood Council passed By-law No. 2024-028 on April 8, 2024 under Section 34 of the Planning Act.

Location: 58 George Street, Collingwood

Legal Description: Plan 186, Lot 6 N PT Lot 7; Town of Collingwood, County of Simcoe

Area: 0.13 hectares

The subject property is located on the south side of George Street and the east side of Ste Marie Street.

The purpose of the Zoning By-law Amendment is to rezone the subject lands from Community Services (CS) to Community Services Exception Eleven (CS-11) and Residential Second Density Exception Thirty-Two (R2-32) to facilitate a future Consent application to create one new residential lot on the eastern portion of the property.

The effect of the R2-32 Zone is to decrease the minimum rear yard for a detached accessory building to 0.8 m, decrease the minimum rear yard for a residential dwelling to 1.1 m, decrease the maximum height of a detached accessory building with a rear yard less than 2.0 m to 5.0 m, and decrease the maximum height for any portion of a residential dwelling that is located within 7.5 m of the rear lot line to 6.0 m.

The effect of the CS-11 Zone is to decrease the minimum front yard to 5.9 m, decrease the minimum exterior side yard to 4.9 m, decrease the minimum interior side yard to 7.2 m, decrease the minimum rear yard to 4.9 m, permit an unenclosed step or set of stairs to project into the required front yard a maximum of 2.0 m but not closer than 3.9 m to the front lot line, decrease the minimum entrance width to 3.4 m, decrease the required setback of a non-residential entrance abutting any residential zone to 1.7 m, and permit a maximum of three (3) entrances, representing portions of the parking area. 

Public and Agency comments received: All written and oral submissions received in response to the application were considered in making an informed recommendation and decision as summarized in Staff Report P2024-06.

When and how to file an appeal:
An appeal of the decision of the Town of Collingwood Council to the Ontario Land Tribunal (OLT) must be filed with the Town of Collingwood no later than 20 days after the date of this notice. The last date of appeal is May 7, 2024. The appeal package should be sent to the attention of the Clerk, Town of Collingwood, P.O. Box 157, 97 Hurontario Street, Collingwood, Ontario L9Y 3Z5. The appeal must set out the reasons for the appeal and be accompanied by the fee required by the Tribunal as prescribed under the Ontario Land Tribunal Act. Who can file an appeal:
Only individuals, corporations and public bodies may appeal a by-law to the OLT. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
