Who gives a rats arse if they have too make sure that they got the right guy when they arrest him. If they arrested the wrong guy apologize and get on with the search. And why did it take city police two days to inform the public about someone who they call 'armed and dangerous' running around? Our whole system is just screwed...

Sad, but if the victim pulls through, Mr. Seaton will likley turn himself in to face a lesser charge, much like the incident at the Rosy. If not, the police will have to catch him the hard way, which will probably include him being caught at a house party on a Monday night, drunk, with drugs on him, while he's creating a disturbance...

@Tag33&1/3rd - I can say with 100% confidence that based on my experience, any armed encounter escalates quickly. When you start off with deadly weapons, there's no where else to go.
That being said, I'm fed up with feeling like I'm not effectively able to defend myself, my family & my property under criminal & case law. Unfortunately, if we didn't have these restrictions (i.e. Sec 25 & 26 CCC)then people would take things too far.
dust2 2/10/2014 4:29:12 PM Report
B Boy, I share your frustrations. I've been looking into self defense while trying to avoid any issues with the law, and it seems that there is little you can do. any object can be considered a weapon, so even in self defense you would be charged with assault with a weapon. learning self-defense with your body is an option, but is weak against someone with a weapon.
we don't even have conceal carry unless you request it, which apparently requires justification. aka if you are constantly being jumped and assaulted, you could be eligible for one.
it's beyond frustrating. I want to protect myself but the law either prohibits me, or punishes me for doing it. I don't want a crime on my record, but I don't want to be hurt/killed as a victim

Verbatim 2/10/2014 6:58:25 PM Report
the laws are quit specific about defending yourself..though you may here differently from different sources my source comes come directly from a defense lawyer....you can defend yourself if you feel your life is in jeopardy or if u feel that someone might act in an aggressive way towards you this also extends to your family.. you are allowed to use reasonable force even if that force results in a death. but you must take into account that this force can not go beyond your ability to be safe, in other words if the assailant is down and out you cannot continue to defend yourself anymore
B Boy 2/10/2014 8:08:31 PM Report
@verbatim - it's not that black & white.
The criminal code is one thing, however case law states another. Case law determines how the criminal code is applied under circumstances such as self-defence, defence of a third party..... There's also the argument of liability. I.e. Did the defender appropriately warn the offender and take steps the "reasonable person ought to have taken".
There have been many, many people who thought they were acting legally and appropriately however they find out the hard way.
Then there's the potential for civil litigation. Civil litigation's application of case law, evidence, etc. is entirely different from criminal.
Regrettably in Canada, laws related to defence are far from clear.
MikeyJ 2/10/2014 8:20:42 PM Report
So much misinformation! Figure out how our legal system works before you complain about it at the very least. The crown can only work with the information that is given and investigated(which often is the big problem!). Judges interpret the laws and hand down sentencing mostly based on precedent. Trying to set a new precedent is a lot more difficult than people understand.

First of all people,
Not all people who live in the west end are 'losers'. This Trevor guy obviously is one, but he doesn't even have an exact address!! He's no better than that guy who begs for change at the entrance at Walmart(now that guy I actually feel sorry for).
Some good citizens just like to purchase a home for 75grand instead of 300grand, so what? They can save a hell of a lot more money than you!!! Especially if they work at the plant. They can just walk there! You can always add security alarms!! Doesn't mean they don't have any money, or aren't ambitious, etc, etc. It shows that material objects don't mean that much to them. Doesn't say anything about their bank statement. Besides, if you live by the steel plant you'll have less of a chance of getting your home broken into. It's more financially smart.
I, personally live in the east end, but have no problem with people living in the west end. I don't generalize them ALL to be losers. That is just stupid. Ok, ok, a lot of them hang around there. But, it's not like they steal from others who are poor..
Did you now? Ok, when was this exactly, in the 70's when 'everybody' was on cocaine???? Or the 40's when everybody was nice? Probably the 40's as people were a lot more sane then.. I don't know what to blame the increase in douchebags around this city. But i'm pretty sure bullying isn't the answer entirely.. He should have had some better parenting, my opinion... Bullying usually leads to more violence from the victims of bullying.
Also, where did you find out that the victim 'succumbed' to his injuries????
To the other people on here,
Look, this guy is a fattie, you can tell by looking at his face.. If any woman thinks this guy is an 'alpha male'; sorry, but you're a bit retarted. He's alpha, only with his gun(or with a piece of crap) in his hand--or if you're sleeping and he sits on you....

They get them in jail but it is the JUDGES that dont keep them there...voice your concerns to the federal representative They are the ones that are accountable...not the police...and the judges think they know a lot but in reality they know little

Well I have sat here for 3 days reading all these judgemental comments. Do you realize Sault Ste marie is the only city in canada that has a page like sootoday that lists the crimes with names, addresses and allows comments with the acception of pedophiles, because don't you know we have to protect the victims so the pedophiles names are not listed. That says a lot for our city. A large number of our citizens have nothing better to do than comment, exagerated and judge on the criminals. How often do you see sootoday state someone was actually innocent or the evidence from the police was incorrect or false(heaven forbid with our fine police force). For all you people that have comments on the judicial system you might want to start with the young offender facilities that are like a Holiday Inn for these kids. Why wouldn't they want to return. Than you have parents that beg for their children to go to a counsellor and they are told no-one can be forced to go to a counsellor. The number of male inmates raised with an absent dad is sickening(hello abscent dads). Most of these criminals have been assaulted by our police (upstanding citizens) of sault ste marie, then they send 18 yr old boys to the penetentaries for break and enters,no violent or drug crimes. Believe me if they weren't broken before they went in they are when they get out. They are then released to the streets with no place to live, no job because if you have no address you probably don't have a phone that employers can call you on. So they hit the streets and sleep on the first couch and hope that they can try and stay clean while they are sleeping on the couch in a crack shack. Sometimes these young men give up, they feel there is no hope of ever having a normal life and they turn to drugs and crime. If you think for one minute the judicial system helps these young men or even attempts to, you are misinformed and ignorant to our whole judicial system. All of you who have nothing better to do than write on here, start writing to our Minister of Corrections to change the system from young offenders when they are still babies to the system.Unless you know these young men that are named all over sootoday, you probably shouldn't be saying a word. If you sat in a room with them and didn't know who they were, you would never know that they were the people listed on sootoday. A lot of them are well spoken and mannered are not disrespectful to everybody and were raised knowing right from wrong. My heart goes out to the victims family this is not fair and it is sad for all parties.

You become exactly like the 5 closest people you hang around. It has been said that your income is approximately the average of your 5 closest friends. You pick up their habits and traits. Jail is clearly not the answer.
Also, the way our police force treats people is absolutely ridiculous. They're completely arrogant people who have no respect for others they don't know and think they can do anything they want(Eg. Pulling me over for doing 85km, 20 feet before the 80 sign is a bit extreme). Doesn't even matter what city you go to, they're all the same. I personally know a man who got beat up by two officers years ago...
However, A lot of criminals are FAR from nice, polite people! I disagree with you on that one. I don't really blame them for being so pissed off. I'm still kinda pissed off too....
Also, These 'young' men(as you like to call them--even though he's 28 years old!!) can go on welfare, get housing help, go to employment solutions and have somebody help them out for their work situation. You can ALWAYS get started as a Janitor-it's a start! If you start working you can save some money(but only if you've got a significant other to help). They can also go to a dorm and take osap, etc. Options are available for these people....
