OPP charge ATV driver with impaired driving
GOGAMA (Septembe r 15, 2013) – The Gogama Ontario Provincial Police has arrested and charged a Timmins man stemming from a routine traffic stop of an off road vehicle on Hwy 144 in the Gogama area on September 14.
While patrolling the area, an Ontario Provincial Police officer had occasion to observe an off road vehicle being driven on Hwy 144 by a driver who was not wearing a helmet.
The driver was stopped and interviewed at the roadside.
Based on the observations made by the OPP officer, the driver was required to complete on site breath tests.
Based on the outcome of those tests, the driver was arrested and brought to the OPP detachment for Intoxilyzer breath test procedures.
As a result of the investigative steps taken by the OPP, Jason Bertrand, 38, of Timmins, Ontario, has been charged with:
• Operate Motor Vehicle – While Impaired, contrary to the Criminal Code of Canada
• Operate Motor Vehicle – Over 80 Mgs of Alcohol, contrary to the Criminal Code of Canada
• Unlawfully Drive an Off-Road Vehicle on a Highwa,y contrary to the Off Road Vehicles Act
• Fail to Wear Proper Helmet, contrary to the Off Road Vehicles Act
• Operate Off Road Vehicle – No Insurance, contrary to the Off Road Vehicles Act
• Operate Motor Vehicle With Open Container of Liquor, contrary to the Liquor Licence Act
• Fail To Surrender Driver’s Licence, contrary to the Highway Traffic Act
He was released from police custody on a promise to appear requiring him to attend Provincial Court in Gogama on November 25th , 2013, to answer to the charges laid against him.

This OPP news story from Gogama is probably to compare the different type of policing that is practiced there to the type of OPP policing that is practiced in the Sault Ste. Marie area.
The following is from an OPP report on a similar incident that happened in Batchewana First Nation.
"At approximately 4:00 pm while OPP officers were at the scene of a serious motor vehicle collision on Friday, September 13, 2013 on Superior Street on the Batchewana First Nation, they observed a driver not wearing a helmet southbound on a three-wheeler ATV weaving from side to side as it travelled down Superior St. towards the collision scene.
The three-wheeler stopped as it approached two fully marked OPP cruisers that were bordering the collision scene.
As a result of further police investigation thirty-one year old Spencer Frederick McLaren of Highway 563, Batchewana Bay was arrested and charged with Impaired Operation of a Motor Vehicle and Exceeding 80 milligrams blood alcohol content while operating a motor vehicle contrary to the Criminal Code of Canada.
The accused was released on a Promise to Appear for Provincial court on October 14, 2013."
