Sam C 3/2/2013 9:10:09 AM ReportWhen drivers refuse to give a breath sample, I always wonder whether they really believe that by refusing they might avoid being charged, or whether they are just too drunk to think straight. I think probably the latter.
Either way, if you plan on drinking, then plan on taking a cab or having someone else drive you home.
mac2 3/2/2013 9:55:49 AM Reportmaybe this will help sam c with his wondering,

mac2 3/2/2013 9:57:35 AM Reportalso, not a whole not will stop you from getting charged, but i wouldnt worry so much about the charge, it's the conviction the matters.
jojoe71 3/2/2013 11:26:18 AM ReportQuestion for you learned people. I hear when you blow over the limit they take your car to the pound ; bring you to the station and charge you with the offence then it's up to you to get to where you want to go. In this case he refuses a breathalizer; does he just continue on his way after being charged with refusing a road side test?
Menard6969 3/2/2013 11:47:23 AM ReportNo, as soon as you're charged you're also slapped with an automatic suspension of your drivers license = no driving.
JustMe1234567 3/2/2013 5:50:20 PM ReportI would also guess that they took him to the station to book him, and possibly try for another breath test.
Just a guess tho.
