Sault man charged with possession of child pornography

45 year old Michel Joseph Portelance of 12 Herrick St. was arrested and charged with possession of child pornography. 
 
On the 23 of January 2013 officers attended at the above residence in regards to a complaint of found child pornography, as a result a computer and a USB flash drive were seized.
 
A search conducted on these items revealed the possession of child pornography images.
 
He was arrested on the 25th of January and held for WASH court.

Horrible. We've got to stamp this out of our community.

Please don't ever turn a blind eye to this, if you see something like this and it's your brother your uncle, who cares, do the right thing and turn them in. Even if it is a young kid you think is just goofing around, turn them in! People that enjoy viewing this are sick sick sick.

They need to be reported. Even if you have to do it anonymously, do it!

The kids in these pictures are being horribly abused. Those who seek out and view these pictures are driving the industry that keeps these kids in abusive situations.

there's never enough that can be done to punish people who offend against children, i know of too many people in this city who have taken advantage of the innocent and are still walking around and sucking air. i just wonder why we can't out them in social media? i mean if they were convicted but released on parole under the condition they stay away from the children they violated, why can't we warn the public when we know who those sick ba**ards are? i usually let people i know personally who they are when i find out, kind of word of mouth to warn ppl why not on FB or even a forum like this? any thoughts?

Put him in a room with the families of the kids and look the other way. No different than a kiddy diddler and a disease like that is not worth wasting tax dollars on. We need the death penalty back so that we don't have to support a waste of skin and air like this in jail.

"I don't pretend to know how or what might stop or control his sort .

I've always thought Tattoos should be designed,one for child abusers,another for sex offenders, drunk drivers etc .

They should be made to have this Tattoo put on their foreheads.

I know it's not practical or probably even possible ,but I enjoy the thought.

While I understand why people suggest the "solutions" they do, I don't believe either victim-family beatings nor amputations would be effective. Those are punishments inflicted upon single individuals.

Unfortunately, there will always be those with sick minds who rape, torture, and commit murder.

Even the death penalty, where it exists, is not shown to be a deterrent, for whatever crime it may apply.

It's a good idea, but it wouldn't fly legally unfortunately.

In this case the man is 45 so it's pretty clear he has some sort of mental issue, but Child Pornography laws in this country are a bit flawed. For example, (I'm not advocating this but...) A 17 year old could have a picture (you know what kind of picture) of his or her 17 year old boyfriend/girlfriend that they keep only to themselves, and never show anyone. They would still be charged with child pornography.

It's an interesting subject and here the intent was obvious but in other cases it's not.

Courts have already JUDGED that its legal to own child porn but not legal to make or print it..who wants to hang some judges ????

It is most certainly NOT legal to have child pornography.

Court's have held in VERY LIMITED circumstances that some forms are permissible to have, but this extends only to such things as drawings and stories made up by the individual - AKA not instances where there is an actual child being victimized. Fantasies in the mind that don't hurt anyone else are legal - but once you include a victim in the form of a picture or otherwise, then it is most definitely illegal.

"There is an exception for material with artistic merit, educational, scientific, or medical purpose"

Otherwise is is seriously (and rightfully so) ILLEGAL

"Canadian law forbids the production, distribution, and possession of child pornography. Possession of child pornography is punishable by up to 10 years in prison.

Production and distribution of child pornography is punishable by up to 20 years in prison.

Browsing for child pornography on the internet is punishable by up to 5 years in prison."

Sadly tho I think the minimum sentence is 14 days. Minimum should be a least a year in my opinion. But the max would do just fine too!

MY POINT WAS A JUDGE AT ONE TIME NOT LONG AGO RULED IT WAS NOT A CRIME TO OWN CHILD PORN .WHAT WAS THE LESSER EVIL TO ME ? NONE. BOTH WERE THE SAME AND THAT JUDGE SHOULD HAVE BEEN HUNG..DONT ANY OF YOU READ PAST COURT CASES THAT SET FUTURE JUDGEMENTS..AND YOU "MUD THROWER"WHEN YOU POINT A FINGER IMPLYING WHAT A PEARSON MIGHT BE .REMEMBER THEIR ARE THREE FINGERS POINTING BACK AT YOU..

so right pete, we are very quick to judge in some instances......but trust me when i tell you this is not one of those times!! i am personally aware of all that has lead up to this guy being arrested and most of the evidence against him......the evidence is irrafutable and vivid, he was not framed, no way no how. although i'm sure he'd love to have you as his lawyer.

I have worked with this guy before, and although at the time it never crossed my mind that was a pedo, he always creeped me out and I always felt that something was off about him. I am absolutely disgusted at what he has done, it is sickning. Hope he his in a cell with a big lonely boy...

Not defending this guy at all, I think he's a disgusting, deplorable human being, and child pornography is horrific and revolting.

I just find it ironic that so many sootodayers seem to think the answer to crime and violence is more violence.

One way to solve the problem of people convicted of child porn, diddlers and rapists is no more protective custody for them!

Just put them with general population, they will take care of that problem!

Wow eh! I just am SO blown away by the courts. It really seems that there isn't enough being done to protect children from preditors. A site that quotes 93% of people who watch child porn are likely to eventually commit the act upon a child. Only 7% will not! That is 7 people out of 100 people~! Thats not good at all! Yet, I found a site that shows that the crime while known to drive the business of making more child porn available to preditors, that the courts are not coming down on these people that have "possession" of it. Its disturbing to me that the courts have minimized it, yet there is plenty of research that shows these people are unlikely to stop viewing children the way they do! You can not learn to have a conscience. People cannot sexualize a child then stop just because society and family and friends hope they do. It is in them, it is who they are, and yet they are at large in our society. I am grateful that he was turned in and I am sure that was hard on the person that did it... they really are a hero~ I am glad the police did their work and found what was there as evidence. I am quite convinced there is a special place in hell just for defence attorneys and I say that because I am a mom. I am disappointed that the courts let this man be released until his court date... bail hearings really should reflect more than if he will show up for his court date,and keep his word on a few restrictions. I am further disappointed because this man will get a slap on the wrist, and told not to go near computers for awhile. I am glad he will move away because that is what they do once they show remorse after they are caught, lost their friends and family's respect. Yeah. They get to start all over, and take their perverted perspective of children to a new town. Punishment doesnt seem to fit the crime. I am sickened by it all...
