Landmark court ruling today on Métis and non-status Indians

The Federal Court has ruled that Métis and non-status Indians qualify as "Indians" under the Constitution Act of 1867.

That means both groups should come under the jurisdiction of the federal government.

It has been estimated that some 600,000 aboriginal peoples are either Métis or live off-reserve.

Today's ruling follows 13 years of legal battles on the issue.

Justcurious, it's likely your ex-wife got it as someone else in her family line had already submitted the genealogical work as proof. I have family members who are registered Ontario Metis, so I could just apply, showing my relationship to the registered members.

IMO, the only real effect this will have is on hunting, fishing, and trapping rights. A lot are whining about spending more money. Metis are unlikely to get anymore money than their "all white" neighbour. StatsCan puts self-reported Metis numbers at about 104,000 in Canada. I would bet it is significantly higher, but people just aren't aware of their heritage 4 or 5 generations back, unless they research it.

As for hunting ,fishing,trapping,it wont be any busier, as those rights were established by the Powley ruling years ago.Get informed before you post.
The Metis and non Status indian are now legally recongized as Indian.The federals will now have to deal with them,legaly.I have been Metis for years,wont change a thing for me and many others.

hitch.... there are laws - these ones are called treaties, just as every province, city, municipality, township including the country of Canada, there are laws.
If you are so adverse to natives achieving what is rightly theirs, start a movement for the rest of Canadians to join and have the treaties abolished. Start by asking the top Canadian govt people if that can ever be achieved, you will be surprised at the answer you may get.
Something like - "when hell freezes over" , or when all Canadians start obeying the laws that apply to them.
Go ahead, start the movement, utopia will arrive in Canada, we will have no need for police, we will all be equal and live happily ever after.

To all those people complaining about teachers making too much money, what about the BILLIONS this will cost now? Lets support these natives that rely on OUR health care and city benefits. If natives get these benefits now, why have reserves? If they live on reserves it is now their choice. This treaty is so old and it exists before we were a country. This was Great Britain, not Canada.

They get all this money but people complain about teacher salary... unreal.

Uh, what billions are we talking about? If you are Metis in SSM, you pay sales tax, income tax, property tax, health care premiums on your tax returns. You use the same medical system as non-Metis, your kids attend schools in the same school boards. You don't get any kind of cheque, rebate, tax deduction or any other perk that isn't available to anyone else, except fishing, hunting, trapping rights.

Despite hitch's previous posts, I would agree that we all need to have equality in this country. To me, being Metis should not require registration, should not confer benefit above any other Canadian, and should not be subject to discrimination. Being Metis, to me, is a part of my heritage, nothing more, nothing less.

How or when this equality will come about is questionable, and I don't expect to see it in my lifetime.

First nations people owned the land they signed legal binding agreements with the government... People don't understand why natives get what they get or the atrocities they suffered. Google the Beothuk people, educate yourself!! Canada's ranking a among quality of life index for it's indigenous people is 63 rd leaving it among the third world countries!!! Native people have suffered ever since white man came here, and they are still suffering today, it's too bad that people are so busy posting inane comments and hating aboriginal people rather than trying to learn about history, about barriers about challenges that native people face in this country! In every major city where homelessness is a huge problem aboriginal people make up a large percentage of that group! Almost 50 % are living in crowded homes, does that sound like " good free housing" to you????

As for the comments about there should be more aboriginal doctors and lawyers, there are plenty just because you may not know any personally doesn't mean they don't exist... And aboriginal people don't just get free education at the wave of the wand, there are criteria in place and expectations of them in order to enjoy that benefit. And a free education is nothing compared to the suffering they have endured. I've said it before and I will say it again, would people tell the Jews to stop whining??

And to those sick of the uneducated and racist comments, read the news on national sites, the comments are much more supportive and reflect the education and open mindedness that exists outside of small cities!! The people on those sites stay current and have a deeper understanding of the issues

You will never change the minds of most of the people on here, but young aboriginal people are showing now that they will stand up to the government that they will fight for what is their's, there will be change coming in this country... o yeah...i do have a job..i own my own home...i pay land taxes..i dont qualify for baby bonus i make to much..i pay for my perscriptions..i will be paying for my childs education..im native and i never use my status card for anything. i stopped when a cashier let out a deep sigh when i did use it..made me feel shitty, so since then i swore id never pull out that card again...

so let me get this straight, from what i have read so far, an agreement was made that the natives get 1% of the natural resources of this country, which means, there is 99% left to go around, and somehow, people are upset at the natives?

Everyone has to do well in high school in order to get accepted to university. Unfortunately, a lot of people (including natives) do not do well in high school. The natives that qualify did do well in high school, therefore get accepted to a university and qualify to get free schooling, and money allowance while at school. Big deal you have to do well in high school to qualify, so does every other race in order to be ACCEPTED to university. Also, what about the natives who decide to go back to school in their late 20's? 30's? They will qualify. I worked with someone who toke an ojibwe class and got money for "keeping current in culture", meanwhile he did it for the money he was receiving. I mean, I wish I had my schooling free and everything, but it isn't fair to every other hard working citizen who I am sure have it worse than most natives today who aren't affected at all by the treaty hundreds of years ago. Do African American's get anything in the U.S. for being slaves before? No. Do Jewish people get any benefits for being put in gas chambers by Hitler? No. Do these people complain that because their ancestors (more recent than those of 200+ years ago) had no rights? No. Grow up and stop taking hand outs and expecting more when the natives here have full access to the city and its privileges.

Blacks don't receive anything for their sufferings?????? NAACP, and UNCF come to mind. The united states funds several initiatives to ensure that blacks have access to education in order to give them a hand up based on the atrocities they suffered in their history with the united states!!! The Jewish people don't get anything for their suffering???? Israel!! The united states for example provides 3.1 billion dollars annually to help ensure the security and protection of the piece of land that was carved out for them so that they could thrive heal and have their independence as a democratic state!! As for treaties christina216 is correct given that blacks were brought over as slaves they didn't own any land to barter with... As for the " these things happened 200 years ago I had nothing to do with it" the last residential school closed in 1996 so if you were over 18 at that time you participated in a government that would allow it, native people got the right to vote so your patents and grandparents participated in a government that would allow that!!!

I would trade places with the first nations here; not with those in Atiwapiskat. Those are the natives that need these benefits; not the natives that live closer than people in Echo Bay that receive the same benefits as them. The natives that truly do go without are the ones I feel sorry for. I mean, for quite some time they complain not getting enough yet they have more benefits than white people AND those of Atiwapiskat. It is a same that blocking highways and threatening toll booths on highways since you know that is racist since natives will not be charged. What if I opened a toll booth and said black people have to pay a toll, noone else. It is racist. If the natives here want to revert back to being like their ancestors were, stop using S.S.M's grocery stores, LCBO, beer store, hospital. etc.

I am in no way racist but honestly the stuff they get away with is unreal. If I wanted to protest high bridge tolls and blocked the bridge I'd get arrested. There are much worse reserves. In Thunder Bay, MILLIONS of dollars were put into housing in a reserve for a population of like 1800 people and the chief there is making 250k. There is so much misused money in this province, over spending by government, cutting wrong areas (research, MNR, law enforcement, hospitals) and this needs to stop if Ontario wants to get out of debt. No other province is in this shape and it is resulting in our youth leaving for the West coast, overseas, etc. The Sault will be like Elliot Lake in a decade or so when our youth that is in college will leave because there are no jobs here. Everyone says teachers should take a pay cut (even though that is not what Bill 115 entails) but why don't the natives give back some money to help out Ontario... or do you still not want to be a part of Canada but get the benefits of being Canadian.

im 100% native..but i dont live on the reserve...my friends just had a baby and they are both 100% native which means the baby is 100% native. my parents are 100% native and they live on the reserve. they cant speak the native language because they were not allowed..their parents were beat not to speak ojibway or practice their culture ways..

so let me get this straight, from what i have read so far, an agreement was made that the natives get 1% of the natural resources of this country, which means, there is 99% left to go around, and somehow, people are upset at the natives?

christina, i know you mean well, but saying stuff like that wont help, and will only fuel the fire. no disrespect to you. keep positive, inform positively(i know it's hard sometimes), and dont give in to the name calling, racial comments, etc, etc.

first, i dont see anywhere in the video saying your tax dollars are being used,and if somehow i missed it, it is a lie, secondly, this is a biased news clip, one person's opinion on the matter, this is in fact, not actual proof.

might want to look into it more then just throwing up a link to a biased news vid and thinking you or this guy for that matter is right about something or that you just discovered some new break through.

I might be wrong in some of my statements below, and you can (kindly)correct me if I am...

I think (not positive) that the natives on the reserves in this area do ok for themselves compared to some reserves.

It is the every-day joe natives and their families living up on reserves like Attawapiscat that I feel terribly sorry for. They do without, while Teresa Spence and her "priviledged" group of Elders, friends and family live high off the hog.

I'd truly like to know WHY do the every day Joe natives put up with this? They live in poorly insulated shacks with no running water, no plumbing, leaky roofs, no proper school, etc, etc. I would LOVE to see the house that Teresa lives in. At the very least, I imagine that she has running water, a flush toilet, and a roof that doesn't leak... possibly even a dishwasher in her kitchen?

I think the rampant corruption up there in those reserves is disgusting. Why don't those natives revolt against the tribal leaders? Can they not force their chiefs/band offices so they get their equal shares? I say chiefs, because the money can't be distributed by anyone but the band offices if my information is correct?



The parents on these reserves who drink themselves into oblivion or self medicate with illegal drugs, don't get any sympathy from me. Their teenagers are either following in their footsteps or are commiting suicide in despair. They should take that booze/drug money, and move the hell off the reserves if they want a decent job and better life for themselves and their families.
I am only saying "get off the reserves" if there is no industry or jobs available.

BTW, the treatment of the children taken away from parents and put into residential schools years ago is totally disgusting. How sad that those children suffered in silence and didn't have a way to bring those attrocities to light.

ALL the natives talk about is there up bringing, and how they had it so bad. they were abused, parents where always drunk, there poor up bringing, had no money.

pretty sickly all the time a Native gets into trouble...here are the reasons
1. I am a native
2. My parents where drunks
3. I was abused all the time
