Secrecy requested, but full disclosure needed by Elliot Lakers

Statement from MPP Michael Mantha on request for secrecy at Elliot Lake mall collapse inquiry

ELLIOT LAKE - Algoma-Manitoulin MPP Michael Mantha issued the following statement after learning mall owners and engineers have asked that some documents be kept secret at a public inquiry into the Algo Centre Mall collapse.

The purpose of this inquiry is to provide the community of Elliot Lake with some much needed answers in the wake of this tragedy.

Keeping important information from the public will only hinder the ability to learn from any mistakes and prevent this from happening in the future.

Elliot Lakers need to begin the healing process; answers and full disclosure will assist them with this.

I have full confidence in Justice Belanger and his team that this will be an open and transparent process.

I have no doubt that Justice Belanger will carefully consider all documents being submitted, and when confidentiality should be considered.

I have been in communication with my federal counterpart MP Carol Hughes, and we will continue to support the community of Elliot Lake throughout this process.

They want financial records kept secret so they can hide what they are worth. The reason? They valued themselves lower than they are actually worth to avoid higher payouts in lawsuits.

In their application, mall owners Robert Nazarian and his son Levon say they have given the commission sensitive financial statements they want kept out of public view. The documentation was part of their Nazarians' request to prove to Belanger they needed taxpayers to pay for their legal help at the inquiry.

"There is a high expectation of privacy in relation to personal financial information," they argue.
In his funding decision, Belanger said he was not impressed with the quality of the material submitted.

"Applicants seeking funding must be forthright and provide the commission with a clear picture of their net worth," Belanger said. "In my view, their evidence is wholly deficient."
Schabas said the public should know what informed Belanger's decision.
"Once you file something and you're asking for a commissioner to make a ruling based on some evidence, that evidence should be public so we can understand why he's going to give them funding or why he won't give them funding," Schabas said.

Public inquiry aside, based on the owner's claims of financial hardship, I have a feeling that the town of Elliot Lake and its taxpayers will end up footing the entire bill to demolish and clean up the rest of the structure.

He is a real piece of work!! He is only trying to avoid responsiblity. He wanted to sell it for 10 million knowing it was gonna fall apart. Yes I am saying he knew.... hell everyone else knew too!!

Before it collapsed some citizens started to petition the city to fix their mall, it was the center hub of Elliot and everyone misses their gathering place. That same group providede alot of pre-collapse evidence of the cracked walls and the fact that the inspections were on the shady side shows he is just another slumlord!!
