Break and Enter reported on McMeeken St.
Jewelry and camera equipment was taken.

Two attempt Break and Enter were reported to Cumbland Ave. and Bishops Crt.
In both cases the intruders were scared off by the home owners.

I have to assume that whoever has the gaul to enter my home while we are present is an immediate physical threat to my family. I will take my chances with a jury later and i can tell you that if i am in that jury i would think that any force used is not excessive. It is time that the law abiding citizens of sault ste.marie fought back .
BlackHelix 10/28/2012 11:32:10 AM ReportWhat are you guys talking about? If you don't know the laws, just learn them. All Canadian (and provincial) laws are freely available online. Why would you trust some random anonymous comment on a local website?
Secondly, the Canadian criminal system is not as black and white and you think. Most of our laws are not clearly defined and open to interpretation by the Supreme Court of Canada - the cases in which are also available online. If you want to really know what is within your legal rights, go find out. Otherwise your just posting and re-posting ignorance.
Zarm27 10/28/2012 11:50:59 AM ReportYeah in the end it'd be up to the court/jurors to decide, since any attorney would argue that by holding a weapon prior to encountering the criminal would be intent to harm, it could be said defense, but by having it by your bed it'd be seen as you having a violent/paranoid personality. It'd be better to encounter them, just grab onto them and the second they struggle grab the nearest blunt object. Even if a person wakes up to find an intruder, and the home owner has children, he would not be found guilty by anyone for protecting himself/family. Although, it would be pretty ironic if the intruder became paralyzed due to the beating he receives, then later sues and is finally considered unable to work so is supported by the government legitimately so he can continue to live his life minus the crime, unless he has a ramp.
My opinion is all crimes that are violent, should just have the criminal executed. It'd save time and money.

To address your specific concern, the law states that:
f you are unlawfully assaulted and you cause death or grievous bodily harm in repelling the assault then you are justified if:
(a) you caused it under reasonable apprehension of death or grievous bodily harm from the violence with which the assault was originally made or with which the assailant pursues his purposes and;
(b) you believe, on reasonable grounds, that you cannot otherwise preserve yourself from death or grievous bodily harm.

The trick is to inflict as much damage to the person and "NOT" allow them to set one foot outside your door before or after doing so. If you must... drag the bludgeoned body back into your home...
I dunno... even in my young age my eye sight plays tricks on me... I thought I saw a pistol in his hand... that's why I shot him...

Leftheel 10/28/2012 4:46:26 PM ReportI agree with everyone willing to defend themselves, if you do get/have a dog make sure you don't only post a "beware of dog" sign, it can be seen as an admission that you knew your dog would attack. Get a "no trespass" sign and cover "beware of" so it only reads "no trespass dog" should make life a little easier when your dog takes a chunk out of whoever makes the mistake of entering your home!
