And furthermore...on the Rob Ford affair, as much as it pains me to say it, as I really don't like the guy and what he stands for, in all fairness, the punishment does not fit the crime, in this case.

He should have been reprimanded, warned and reminded that he is an idiot. Allow him to finish his term as mayor and let the people of Toronto speak. They voted him in after all.
The sentence was a little over the top.

In our very own city of Sault Ste. Marie we've had far more serious shenanigans in the past ....

Things like that make me wonder what it is that compels folks to run for public office . One might as well join the circus.

I still haven't looked at yesterday's Toronto paper with details of the Ford fiasco.
On first blush it does seem like overkill but it may have been how the judge had to apply a narrow law.
The guy seems to be a flatulent bully who saw an election victory as a coronation. But that is not a hangin' offense.
My fear is that if there is a new - and expensive - election and he wins he'll see it as a mandate to ratchet up his agenda.
If he lost the election he could blame the 'left wing courts and the lefty liberal media' and become a martyr for all the neo-con iconoclasts in the GTA.
Sort of a right wing poster boy for why the world is becoming too liberal.
At the least we'll probably see more of what started here yesterday - ignore what the guy did and focus on how he was unjustly punished.

Traffic light at Lukenda Drive .Whom ever made the decision to have it operate in it,s present form was,nt thinking.Entry only, no exit except emergency vehicle.Only enter right hand turns on Hwy 17.Enter from North 3rd line.
All the traffic that has to stop for one or two vehicles.Heavy trucks, cars, busses, motorhomes, travel trailers,ect.What a waste of gas and more polution starting up and now they do it all over again at the 3rd line.Exit from the hospital 3rd line only.

When you're so STUPID that you stand up as the Mayor at city council and argue that you shouldn't have to pay back money that you obtained inappropriately through your city council office, and then vote against having to pay back the ill-begotten funds you sure need to be turfed. And fast!

Next you'll be saying Rob Ford can speak on his own behalf, and use his influence with city council, to get the Toronto CAO position or speak on behalf of his sister's paving company for city paving jobs, or ...


The guy's a dunkoff. He should've just kept his mouth shut and paid the $3,000. End of story.

I just heard snippets on the radio and glanced through the news story....the man just doesn't interest me that much.
I guess you're right, even if it wasn't blatant corruption one should know and abide by the rules especially when at the head of the largest city in Canada and he should have been aware that his every move will be scrutinized. It does appear the man doesn't give a s_it, but now he must!

From Fatso Ford to a perverted principal.It reminds me of all those parents who defended their children's behavior by saying that:
-he certainly wasn't the only one and was being discriminated against;

Neither of those are capital crimes but serve as part of a mosaic of the guy's personality.
At the very least he continually shows a lack of mature judgement.
However somewhere there is a line between being 'colorful' and acting beyond common sense.
That kind of stuff worked before the days of instant social media. Today he is less a victim of 'the lefty media' than the author of his own arrogance.
In time he will be relegated to the garbage heap of supposed saviors of society from bleeding hearts.
The GTA is a big diverse group.

Seems like overkill in the extreme, that one or two left-wing union activists, one lawyer and a judge, can now uproot what a few hundred thousand voters put in place.

And all over using city letterhead, to write a letter for donations to a football team - which, incidently is for under-privileged or at-risk youth who live in "the projects" in Toronto.

First of all - Ford was found guilty by a judge because he broke the rules.
To suggest it was engineered by lefties is stupid.
But once again we get 'innocent by deflection'.
As for the football team, it is Don Bosco HS.I've been there. Like all schools in the 416 area it attracts mostly minority kids. So it isn't much different except it was founded by a Catholic teaching order of priests.
Ford has been dancing around the rules re. conflict in the donations to support this football program since December of '09.
Now his brother is calling for his supporters to show their support for Hizzoner at tomorrow's Metro Bowl in Toronto.
What does that have to do with kids' football?
Finally - a judge has also ruled that Ford cannot run in any new election for his seat - not lefty journalists. A judge.
It does not matter what percentage of the vote Ford got because he broke the rules before and after the mayoralty election.
Pity I didn't go to see SMC this year at their Metro Bowl. I could have walked by the Ford brothers and saluted them.

Rob Ford has gotten more attention on here than he deserves.
I don't see him as big an issue as the sadly predictable finger pointing as to why he got canned.
He wasn't done in by lefty media or abducted by aliens.
He thumbed his nose at the rules for too long and finally got nailed.

learning: as usual, you have a very naive take on things. Sure, Ford's action was not horrible, but, as the judge said, he had a "stubborn sense of entitlement" like many who achieve power do. Witness our own CEO. Ford could have easily got himself out of this but thought he was above it all.
As an analogy, we all know about the marijuana laws and how the great majority feel the laws are not reflective of their beliefs. I know many police officers concur. What Ford metaphorically did is basically walk up to a police officer and blow marijuana smoke in his face. What else could the judge do?

Neither were the people elected who lodged the complaint against Joe Fratesi when he got the job of CAO. In conflict cases, it is usually members of the public who lay the complaint. In regard to your backroom comment, in that post I have no idea what the hell you are saying but it is probably a stretch.

Long before the public got involved Ford was in trouble. He was ordered to pay back the money by the commissioner. He didn't want to and this was his undoing. He spoke at council against his having to pay it back, which was probably a borderline conflict. But then he voted, and won his case. Voting was clearly a conflict and I can't see why anybody would complain about those who brought the complaint forward. Would you have the public disregard conflict in all instances or are there some you could stomach? Politics should have nothing to do in these cases. It should just involve whether there is a conflict or not. That is all a judge can go on. In this case the judge made the right call. Ford only has to sit out this term, which means he can run again two years from now.

He went on to get his PhD but at the time we just thought he was nuts.Now years later his body of work shines and we unwashed recruits he force fed great fiction, rhetoric and debate to marvel at how fortunate we were.
His name was Bob Dixon and his lessons made many of us into the men we are.

The bottom line is the judge that handed down the ruling was, by what he stated, basically saying that if he had the flexibility he would not of ousted Ford as the punishment, it did not fit what had taken place.
...but he had no choice.
What Ford did was not that serious.
There was a panel on CBC this morning debating it and that was also the overall consensus, this law carries to big a hammer, no flexibility and needs to be rewritten.
This issue it not over by a long shot.

However much we disagree on some political views, I think we both agree somewhat on the integrity politicians should have, wether municipal, provincial or federal. When someone is first elected they should try and learn what the basic rules are, so they do not fall into the trap of entitlement. It seems Mr Ford did just that, and did not have the decency to come clean, admit he had done wrong and accepted that fact. What really Pss's me off is that, it has cost the taxpayer thousands of dollars, taken time in court,which could have been better spent prosecuting a real criminal, who has hurt someone physically or financially and will now be able to kick back for a few more weeks because this case had to go thro the system.

Yes, he had no choice because he found Ford guilty. Once that happened, what would you have him do, just say, "OK, carry on." The following is from the judge's ruling. I think it is quite clear, when he talks of Ford's stubborn sense of entitlement and dismissive attitude toward the commissioner and Code of Conduct, where he stood on the issue.

71. For the Mayor, integrity in government should be a top priority.

The Mayor of Toronto has many responsibilities, pressures, and functions, but perhaps the greatest is providing leadership for integrity in government. The Mayor is the face of City government, both internally and externally. Maintaining the integrity of government is the Mayor’s most important job.

In view of the respondent’s leadership role in ensuring integrity in municipal government, it is difficult to accept an error in judgment defence based essentially on a stubborn sense of entitlement (concerning his football foundation) and a dismissive and confrontational attitude to the Integrity Commissioner and the Code of Conduct. In my opinion, the respondent’s actions were characterized by ignorance of the law and a lack of diligence in securing professional advice, amounting to wilful blindness. As such, I find his actions are incompatible with an error in judgment.

[59] In summary, I find that the respondent has failed in his burden to show that his contraventions of the MCIA were the result of a good faith error in judgment.


[60] For the reasons set out above, I have concluded that the respondent contravened s. 5 of the MCIA when he spoke and voted on a matter in which he had a pecuniary interest at the meeting of Toronto City Council on February 7, 2012, and that his actions were not done by reason of inadvertence or a good faith error in judgment. I am, therefore, required by s. 10(1)(a) of the MCIA to declare the respondent’s seat vacant. In view of the significant mitigating circumstances surrounding the respondent’s actions, as set out in paragraph 48 of these reasons, I decline to impose any further disqualification from holding office beyond the current term.

If the judge did not have concerns with this law he would not have taken the time to point out what he did.
Of course he found him guilty, that is not being disputed what the judge was basically saying is if he had the flexibility he would have exercised it and not ousted him from office.

Suppose I am a business man, lobbyist, or someone who has business with a municipal government and receives a letter asking for a donation(worthy or not), from the mayor/football coach, on city letterhead. Suppose I don't donate and lose a contract, zoning change, or whatever. Would you always think that by giving or not giving had anything to do with the decision made by the city government?
That is why the Toronto mayor was found guilty and not the money. The judge only kicked him out of office and did not rule to deny Ford from seeking public office in the future. He can run again if he so pleases.

Of course he found him guilty, that is not being disputed what the judge was basically saying is if he had the flexibility he would have exercised it and not ousted him from office.

It is submitted that s. 5(1) cannot be interpreted to apply, as in the present case, to a situation in which a member of council is simply speaking about a potential pecuniary sanction he or she may be facing.

[23] I am, however, of the opinion that the applicant’s position is correct, that s. 5(1) of the MCIA means what it clearly says and that there is no interpretive basis for excluding the operation of s. 5(1) from municipal Code of Conduct matters. Section 5 of the MCIA clearly and broadly states that where a member, “has any pecuniary interest ... in any matter,” and is present at a meeting of council, he or she is to disclose his or her interest and must neither take part in the discussion of nor vote on the matter. There is no basis on which the court can restrict or read down the meaning of “any matter” to exclude potential financial sanctions arising from Code of Conduct violations. I note parenthetically that reading down the operation of statutory provisions otherwise applicable is a constitutional remedy and no Charter issues have been raised by the parties in this proceeding. Furthermore, there is no authority for implying a right to be heard in the face of a statutory provision (such as s. 5(1) of the MCIA), which specifically denies such a right.

[24] As learned commentators have noted, there may be a procedural fairness deficiency if councillors are precluded, at council meetings, from discussing potential findings or pecuniary sanctions which may be levied against them. I would regard these considerations as requiring study and possibly law reform, but they cannot provide a basis for restricting clear statutory provisions. In any event, audi alteram partem does not have anything to do with and cannot provide a justification for voting (rather than speaking) on a matter, as the respondent chose to do in this case

I am really surprised that the Judge removed him from Office before any appeal could be launched.

Let me say that there was no pecuniary interest for Ford except for the money for his Foundation for Sports for disadvantaged children.

He voted for the issue at Toronto Council because he believed that he had no pecuniary interest in the outcome of his vote.

His only mistake was using the Toronto Council letterhead on his appeal for funds for a non-profit group and Ford received no money for himself for his efforts.

I would imagine that the Algoma Health Unit should be able to answer any questions you might have.

My personal take on the radon testing advertising is that they have found something to make a business out of and it's based on fear-mongering. Just my opinion.

The housing market is inching up...slowly for sure, but encouraging.
Most economic markers are pointing up, despite Obama.(smiley face)
Europe is falling deeper into recession and China is slowing down.
Canada is holding steady due to consecutive responsible governments imposing REGULATIONS, with the exception of the one we have now.
Our current government is doing exactly what got the rest of the world in trouble.

There was pecuniary interest. He was ordered to repay the money. That was coming out of his pocket. How can you say that there was no pecuniary interest? It wasn't big bucks but it was bucks.
As for winning his appeal, you were in the political arena long enough to know that it would have been wiser to couch your bets on that one because, according to the judge, there was a conflict, and that was what the issue was all about.

Kudos to the Person who filed the complain about Rob Ford.

Mayor Rowswell was in conflict of Interest over Searchmont when he voted to give them money.

His engineering firm did the contract work for Searchmont.He knew he would get the contract because that work is what his company specialized in.

Yet he still voted and never called a conflict.

Mayor Rowswell was loved by this city because he tried to make a difference.

Mayor Rowswell believed in the potential of Sault Ste Marie and went to Ottawa to get things done.

Mayor Rowswell was lucky whereas Rob Ford had one person with money who got him.No left wing agenda just someone who got it right.
